Some of our cases have resulted in precedent-setting published decisions by the appellate courts in New York. For example, in Delprete v. Victory Memorial Hosp., 191 A.D.2d 673 (N.Y. App. Div. 2d Dep't 1993), the firm succeeded in establishing that a hospital could be liable for the actions of an emergency room physician even though the hospital administrator denied that an employee-employer relationship existed between the hospital and the doctor.
